CMAK Digital – Partner Portal Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CMAK Digital Partner Portal located at partner.cmak.com.au (“Portal”), operated by C&M Tech Pty Ltd (CMAK Digital) (“we”, “us”, “our”). By accessing or using the Portal, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Portal.
1. Purpose of the Portal
The Portal provides clients of CMAK Digital with access to information relating to their digital marketing services, including but not limited to:
SEO performance and reporting
Facebook & Meta advertising performance
Google Ads performance (if applicable)
Project notes, updates, tasks, and deliverables
Billing and account information
Communication history
Strategic documentation, files, and insights
The Portal is provided for transparency, progress tracking, and client communication.
2. Eligibility
To use the Portal, you must:
Be an existing CMAK Digital client with an active service or agreement;
Be authorised by the client account holder;
Use the Portal for business purposes only;
Provide accurate information during registration.
We reserve the right to suspend or restrict access if improper use is detected.
3. Account Registration & Security
You are responsible for:
Maintaining the confidentiality of your login credentials;
Ensuring users within your organisation access only appropriate areas;
Notifying us immediately if you suspect unauthorised access.
We may introduce multi-factor authentication or additional security requirements at any time.
4. Data Accuracy & Limitations
The Portal displays marketing metrics, reporting data, and other information sourced from third-party platforms such as:
Google Analytics
Google Search Console
Facebook/Meta Ads Manager
Google Ads
External tools (rank trackers, CRM integrations, etc.)
While we take care to ensure accuracy, data may be subject to delays, API changes, syncing issues, or third-party interruptions.
CMAK Digital does not guarantee the completeness or uninterrupted availability of Portal data.
All performance data is informational only and does not constitute financial, advertising, or business guarantees.
5. Acceptable Use
You must NOT:
Attempt to copy, reverse-engineer, decompile, extract or replicate the Portal;
Share Portal access with unauthorised users;
Introduce malware, scripts, bots, or harmful code;
Use the Portal to harass, defame, or harm any person or business;
Misuse any reporting or communication features.
We reserve the right to suspend accounts or terminate access without notice for violations.
6. Intellectual Property
All content, design, software, reports, analytics, branding, frameworks, strategy documents, notes, and materials inside the Portal are the intellectual property of CMAK Digital.
You are granted a limited, revocable, non-exclusive license to access and view content related to your services.
You must not reproduce, distribute, or modify Portal materials without our written consent.
7. Confidentiality
Both parties agree to maintain confidentiality of:
Strategy documents
Ad performance
SEO methodologies
Reports and insights
Private discussions and notes
Commercial arrangements
You may share Portal data internally within your business but not publicly or with external contractors without permission.
8. Service Availability
We aim to keep the Portal accessible 24/7; however, availability may be affected by:
Maintenance
Updates or upgrades
Technical issues
Third-party outages
Force majeure events
We do not guarantee uninterrupted availability.
9. Fees & Billing
Access to the Portal is included as part of your CMAK Digital service package.
If your service is paused, suspended, or terminated for non-payment or any other reason, Portal access may also be suspended.
10. Termination
We may suspend or terminate your Portal access if:
You breach these Terms;
Your service agreement ends;
You misuse the Portal;
Security concerns arise.
Upon termination, you must cease using the Portal and delete any downloaded materials unless contractually required to retain them.
11. Disclaimers
The Portal and its content are provided “as-is”.
CMAK Digital does not guarantee:
Specific marketing results;
Future sales, leads, revenue, or rankings;
Continuous access or error-free operation;
Accuracy of third-party data.
Use of the Portal is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law:
CMAK Digital is not liable for any indirect, incidental, or consequential losses arising out of Portal use;
Nothing in these Terms excludes rights guaranteed under Australian Consumer Law.
13. Privacy
Your use of the Portal is also governed by our Privacy Policy, available at:
cmak.com.au/privacy
By using the Portal, you consent to:
Data synchronisation with third-party services;
Secure storage of login activity;
Tracking of usage to enhance platform performance.
14. Third-Party Integrations
The Portal may integrate with APIs and services provided by third parties.
We are not responsible for:
Changes to third-party APIs
Data limitations or outages
Privacy practices of third-party platforms
Your use of connected platforms is subject to their respective terms and policies.
15. Updates to Terms
We may update these Terms from time to time. Continued use of the Portal constitutes acceptance of updated Terms.
